The terms for using Verde Vision.

These terms are an agreement between Verde Vision LLC and the firm or person using the service. By creating an account or using the app, you agree to them. We've kept them short and readable; the parts that limit our liability are in plain language too.

1. The service

Verde Vision is a spatial landscape design tool made up of an app for Apple Vision Pro and a web dashboard at dashboard.useverdevision.com (together, the "service"). The app requires an Apple Vision Pro, which you supply. We may update the service, add or remove features, and release beta features that may change or be withdrawn.

2. Accounts and seats

A subscription includes an owner account and a set number of designer seats; additional seats can be added for a fee. The owner is responsible for the people they add, for keeping logins private, and for everything done under the firm's account. Tell us immediately if you believe an account has been used without permission.

3. Trials, subscriptions, and billing

• Free trial - every new subscription starts with a 30-day free trial. Cancel before the trial ends and you will not be charged.
• Billing - after the trial, plans bill monthly or annually in advance through Stripe, and renew automatically until cancelled.
• Seats - on monthly plans, seats can be added or removed at any time. On annual plans, a seat added mid-term is prorated for the months remaining, then renews at the full rate.
• Founding rates - a founding rate applies for the first year of the subscription, after which the plan renews at the standard rate in effect at the time.
• Cancellation - you can cancel from the dashboard at any time. Cancellation takes effect at the end of the current billing period; we don't refund partial periods.
• Price changes - we will give at least 30 days' notice by email before a price change affects your renewal.
• Taxes - prices exclude any applicable sales or use taxes, which we collect where required.

4. Your content

The projects, maps, photos, client details, and price lists you put into the service are yours. You give us the permission we need to store, process, sync, back up, and display that content in order to run the service for you, including showing a design to anyone you send a share link to. You are responsible for having the right to use what you upload, including photographs of clients' properties, and for how you share it.

5. Designs, blueprints, and estimates are working aids

• Plants are modelled at typical mature sizes. Real specimens vary with species, nursery stock, climate, and care.
• Maps and measurements come from the headset's tracking of the property and from where you place points. They are accurate enough for design, not for setting property lines, easements, grades, or utility locations.
• Blueprints are drafted from your placements. You are responsible for checking them against site conditions, building codes, HOA rules, and permit requirements before submitting or building.
• Estimates are calculated from your placements and your own price list. Confirm quantities, availability, and labor before you quote a client.

6. Safe use of the headset

You use the app on job sites at your own risk. Stay aware of your surroundings and your footing; do not use the headset on ladders, near pool edges or drop-offs, around moving vehicles or equipment, or in heat that Apple's guidance says is unsafe for the device. Follow Apple's safety instructions for Apple Vision Pro, and make sure anyone you hand the headset to does the same.

7. Acceptable use

Don't use the service to break the law, to infringe anyone's rights, or to harm the service or other users. Don't resell access, share logins beyond your seats, scrape or bulk-export the plant catalog, extract or redistribute our 3D models and textures, reverse-engineer the app, or attempt to gain access to accounts or data that aren't yours.

8. Our intellectual property

The app, the dashboard, the plant and hardscape models, textures, artwork, and the Verde Vision name and mark belong to Verde Vision LLC or our licensors. Your subscription gives you a limited, non-transferable licence to use them within the service for your firm's landscape work. The PDFs, blueprints, and estimates you generate are yours to use with your clients.

9. Availability

We work to keep the service available, but it depends on Apple's platforms, our hosting providers, and your connection, and there will be maintenance windows and occasional outages. Keep your own copies of anything you can't afford to lose, such as exported blueprints and estimates.

10. Disclaimer of warranties

The service is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that the service will be error-free or uninterrupted.

11. Limitation of liability

To the extent the law allows, Verde Vision LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost data, arising from the service or these terms. Our total liability for any claim will not exceed the amount you paid us for the service in the 12 months before the claim arose. Some jurisdictions don't allow these limits, so they may not fully apply to you.

12. Ending the agreement

You can stop using the service and cancel at any time. We may suspend or end an account that breaks these terms, after telling you why unless the situation is urgent. When an account ends, you can export your content for 30 days, after which we delete it as described in our privacy policy. Sections 4 through 13 survive termination.

13. Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. If we have a dispute we can't sort out by talking, it will be handled in the state or federal courts located in Maricopa County, Arizona, and both of us agree to that venue.

14. Changes to these terms

We may update these terms as the service evolves. We will post the new version here with an updated date and, for material changes, email account owners at least 30 days before they take effect. Continuing to use the service after that date means you accept the new terms.
